Macron’s law and the contract law reform project : additional protection at the cost of legal uncertainty ?

The Economic-Competition-Distribution division of Granrut is pleased to invite you to a breakfast debate on Thursday, 28 January 2016 from 8:30am to 10:00am, on the following theme : "Macron’s law and the contract law reform project : additional protection at the cost of legal uncertainty ?”

    Agenda

The impacts of these two pieces of legislation on business contracts :
    - accounting for the state of economic dependence from the start of contract negotiations,
    - the single duration of contracts within the same economic transaction,
    - the situation regarding post-contractual non-competition agreements.

Towards a rebalancing of power between contracting parties ?

The increased power of the judge : an interference in the relationship between commercial partners :
    - removing judicial clauses creating a significant imbalance,
    - consecration of enforceability,
    - economic violence in the event of abuse of the state of necessity.

A new source of legal uncertainty for professionals ?

Will changes to contracts by the courts also benefit professionals ?

Does this threaten the attractiveness of French law in international commercial contracts ?
